Welcome to megamotormadness.com/E Commerce Inc., these are the terms and conditions which will apply to your purchase from our website. These terms and conditions form a legally binding contract between you and us. By purchasing on Megamotormadness.com/E Commerce Inc., you're accepting the following terms and conditions. You should read these terms and conditions carefully before making any purchase from this Website.

Transactions

You make an offer to purchase a product from us by completing the staged process on the Website as set out below:

On receipt of your Order, we will send you an order acknowledgement email to the email address which you provided in the Order process. This Order acknowledgement email will contain your order number and details of the productsyou ordered. Please note that this email is only to acknowledge that your order has been received, and is not acceptance by us of any offers to purchase.

We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation. We reserve the right, at our sole discretion, to limit the quantity of items purchased and/or to prohibit sales to dealers. In the event that a product is listed at an incorrect price, we shall have the right to refuse or cancel orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we will promptly issue a credit to your credit card account in the amount of the incorrect price.

Cancellations

Cancellations must be made by email ONLY. 

Cancellations of unshipped orders can be completed within 1 hour of processing a payment without additional fees. 

Cancellations after 1 hour are subject to a 6% cancellation fee.

  1. 85% assembled orders

-You may also cancel your 85% assembled order if your item has not been shipped within 1 hour of successful payment.

-If you cancel a shipped 85% assembled order, you will be responsible for the initial freight, return freight and 25% restocking fee. The cancellation fee will apply.

  1. Fully assembled orders

-If a fully assembled order is cancelled and the assembly has not started, 6% cancelllation fee will be applied.

-If a fully assembled order is cancelled  and assemble has started, the assembly/PDI fee, 6% cancellation fee and 25% restocking fee will apply.

-If a fully assembled order is cancelled and the unit has already shipped, the assembly/PDI fees plus the initial freight, return freight, 6% cancellation fee and a 25% restocking fee will apply.

Shipping & Processing

Most of the time we are able to offer standard shipping on all items to 48 continental states without any surcharges. 95% of orders shipping costs can be covered under our standard shipping fee. However, due to excessive delivery rates to certain areas, a freight charge may be required. Our customer service reps will contact you if there is a shipping surcharge on your order. Please refer to the product page for shipping & processing details. During our busy season, this processing time may take longer. Shipping times vary depending on the location the unit is shipped to. Please note that any shipping time stated on our website or given by customer service representatives are ESTIMATES only. We will make every effort to make sure you receive your order in time, but we are not responsible for shipping delays, which can be affected by the shipping carrier, delivery destination (which may include the carrier using a third party company to reach your location), weather, holidays or incorrect/insufficient delivery information. In the event a delay is caused by the carrier, we will make our best attempts to rectify the situation but cannot make any guarantees.

Please make sure to track your package until it is delivered.  We are not responsible for any lost or stolen packages once the shipping carrier marks your tracking number as delivered to your location.  If this should happen, please file a claim with the carrier directly as we cannot confirm the package was not delivered to your location, only you can.  Once you file the claim, please provide us with the claim number you received, so we can file a claim on our end while referencing your claim number with the carrier.  The claim investigation time frame may take anywhere from 15-120 days depending on the shipping carrier's investigation policy (please make sure to check with them when filing any claims of lost or stolen packages and let us know what they said).  We will need to wait for the claim investigation results before we can submit any refund or reshipment of your order.  Please be aware of this and be prepared for the delivery of your package.  Contact the shipping carrier if you want to check on the shipment's estimated delivery date once it shows movement.

It is your responsibility to inform us if you plan to ship your order to the following included but not limited to locations. There will be a limited access surcharge for the delivery or chance that the trucking company cannot deliver to.

Camps, carnivals, fairs, chautauquas, churches, mosques,synagogues, temples, convents, schools, colleges and universities without a dock, medical/urgent care sites without a dock, prisons, construction sites,individual/mini storage units, mine sites, golf courses, country clubs, nuclear power plants, military bases/installations, pars, farms, ranches, Indian reservations, day cares, hotels, motels, bars, night clubs, cemeteries, outdoor flea markets, retirement/nursing homes.

Shipping Instruction

We're not responsible if the trucking company cannot fit on your street. You may have to make different arrangements with our trucking company to ensure your product is delivered which may include picking up your product at the local terminal.

Please be advised that at most time our shipping company can provide lift gate service for all residential deliveries, but at some scenarios it is at the discretion of the shipping company and its representatives to determine if the Lift gate on the truck is capable of lowering larger units such as Extra Heavy Trikes (1500-5000 lbs) and Extra Large 2 wheeled Scooters from the truck bed. You might need to choose one of the following options to receive your unit:

1) Select and alternate location that we may deliver your freight to. This alternate location must have a loading dock and/or forklift that is able to remove your freight from the truck bed.

2) Rent a forklift and manually remove your freight from the truck bed.

Please be advised that due to liability issues, the delivery driver will not be able to assist you in any way with the removal of your fully assembled trike from the truck bed. Additionally, the delivery driver will not help to remove the crate from your trike or dispose of any of the packaging.

Assembly & PDI

All units received in crate needs to be fully inspected and a full maintenance PDI (post delivery inspection) needs be performed. We do not recommend our customers attempt any of the following themselves. You should always have you bike assembled and maintained by certified mechanic. Megamotormadness cannot be held responsible if any unauthorized individual attempts assembly, PDI, repair, or maintenance on any product.

Products that are fully assembled that include a pre delivery inspection should be checked thoroughly to make sure all nuts, bolts, connectors are connected. These items may become loose during transit and we recommend the buyer check all components before riding.

Return Agreement

Megamotormadness.com/E Commerce Inc wants to always make sure your experience with us is enjoyable. Your satisfaction is of utmost importance to us. Should you need to return an item, please review the complete details of our Returns & Exchanges Policy to determine if any special conditions may apply. If you've received and signed for your vehicle from the carrier all sales are final. By accepting your item you agree to waive your rights to file a chargeback claim against Megamotormadness.com/E-commerce Plus Inc.

Product Agreement

Powersports vehicles require mechanical knowledge in order to be properly assembled and maintained. If the purchaser is not mechanically inclined, you will need to take your vehicle to be assembled and inspected by a licensed mechanic upon arrival. Megamotormadness.com/Ecommerce Plus Inc will not be responsible for any damages incurred due to improper assembly and/or maintenance due to lack of mechanical knowledge and skill. Our products are offered to public at an exclusive wholesale price. By purchasing one of our products, you are bypassing a dealership and should perform the same procedures the dealership would perform upon the receipt of the vehicle. This includes assembly, post-delivery inspection and vehicle test. This also may include the replacing and or repair of parts to get the vehicle into full working order.

Warranty Policy

Megamotormadness.com/E Commerce Inc offers different warranty options (standard and extended) for all our products. You can verify the warranty plan you purchased on the sales confirmation copy. For complete information on coverage and limitations of our warranty policy including damage upon receipt, how to file a warranty claim and receipt instructions please refer to our Warranty Policy page.

The warranty covers parts that are covered under the warranty for the duration of the warranty period purchased with the unit. The warranty will not cover any shipping expenses or labor under any circumstances. We have 99% parts in stock at most time, however, if the part required isn't available, a rebate will be offered as compensation.

Megamotormadness.com/E Commerce Inc reserves the right to request proof of proper assembly and inspection by a licensed mechanic at any time during warranty claims and/or disputes.

Important Limitations on Your Rights

You, as the consumer, are aware that by purchasing any item and sending/remitting payment for it/them, you assume all risk, and waive and release all legal rights that you may have or possess. You, as the consumer, therefore release all liability and waive all Legal rights you may have with any items purchased from Megamotormadness.com/E Commerce Inc. Any and all issues or problems will be solved in accordance with the terms and conditions specified in this contract.

By purchasing a product from Megamotormadness.com/E Commerce Inc, once that product has been shipped you agree to waive your right to chargeback your credit card under any circumstance and will handle any and all issues in accordance to our terms of use.

About our website and goods

*Inaccuracies & Changes

We try to make sure that all information on the websites, including descriptions of our products, and listed prices, is accurate and correct at all times. We will try to resolve all information inaccuracies on the websites as soon as reasonably possible, and if we reasonably think that such inaccuracies have affected your purchase of products we will try to let you know. However, because we take these steps we will not be liable to you for any errors on the Websites. We will not accept return or issue a refund for inaccuracies of information on the website.

* Color: The colors which are shown for the products on the websites will depend on many factors – including your computer monitor display settings; Sometimes we are out of stock on one color so that is the reason why we ask you to make an alternate color choice.

* Delivery: Any delivery estimate given on the website or by email is only an estimate. We will try to meet the delivery estimate as closely as we can.

* Model Year: All products sold on the website are brand new in a crate. However we cannot guarantee that the products sold is of the same model year as calendar year at the time of purchase. Inventory is mixed with different model years. If the model year is very important to you, please ask our customer service representative to verify the model year before placing the order on our website. If a customer wants to return product due to model year, the customer will be responsible for all related costs, including but not limited to shipping costs, restocking fees etc.

* Operation, Registration, and License

Purchaser is responsible for registering and operating the motorcycles in accordance with local and state laws and ordinances. Megamotormadness.com/E Commerce Inc., makes no representations that the motor scooters, dirt bikes, go karts and ATVs are legal for operation in your City and State. Customers have read and understood the use of these products before purchasing.

* Waiver of Liability

Warning! The activity of riding dirt bikes, scooters, trikes, ATVs, go karts and UTVs involve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by purchasers own actions or inactions, the actions or inactions of others, participating or not participating in the activity, the condition in which the activity takes place, or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to the purchaser, not readily foreseeable, and the purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of purchasers participation in motorsports riding activity. The purchaser acknowledges and agrees to be over 18 years old. The purchaser understands the inherent risks as a result of riding vehicles advertised on megamotormadness.com/E Commerce Inc., and assume any and all risk associated with loss, damage or injury. The purchaser agrees to release and discharge Megamotormadness.com/E Commerce Inc., their agents, employees, officers, directors and all other persons or entities acting on their behalf and the manufacturer from any and all claims, liabilities, cost or expenses and attorney fees, whether or not such claims, liabilities, cost or expenses are caused by the negligence of the seller, distributor or manufacturer. This agreement shall be affecting and binding upon all heirs, agents and personal representatives.

* Purchasers Responsibility:

The purchaser must inspect all equipment before using it and to take full responsibility for assuring that the equipment is in good working order and safe to use. The purchaser understands the nature of motor scooter riding and motorcycle, ATV, etc. related activities and acknowledges that purchaser is qualified to operate motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate purchaser's products. Megamotormadness.com/E Commerce Inc. will not be liable for misuse of any products purchased from the website.

We will not be responsible for the performance of any obligations under these terms and conditions in the case of an event outside of our reasonable control (force majeure), including (but not limited to) strikes, lockouts, failures of third party systems or networks, acts of god, fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data, or for damage to or destruction of premises or equipment. All notices that we need to give to you under these terms and conditions will be sent by us to your registered e-mail address. If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions (and the remainder of the provision in question) shall be unaffected.
